E-Commerce Times interviewed Gardere Partner Peter S. Vogel, chair of the Firm's Internet, eCommerce and Technology Industry Team, regarding dismissal of a lawsuit alleging that Motorola Mobility charged rates exceeding fair, reasonable and nondiscriminatory terms for its patents.
"There is no uniform definition for FRAND," says Mr. Vogel. "Every single patent has a different value in the marketplace, so determining a uniform definition would be a huge burden for any court."
