Insurer Representation

The attorneys in Gardere’s Insurer Representation Group represent insurers nationally and internationally in complex coverage disputes. We handle and advise clients on insurance claims and bad faith litigation arising from virtually every type of policy form and risk, including:

  • Aviation
  • Business interruption
  • Commercial general liability
  • Contractors liability
  • Credit and financial services
  • Directors and officers
  • Employee dishonesty
  • Environmental
  • Excess casualty
  • Life and disability
  • Professional Liability/E&O
  • Property
  • Reinsurance
  • Secured creditor impaired property
  • Surety
  • Workers’ compensation

Our team also has extensive experience in other forms of risk-transfer devices, such as reinsurance treaties, contractual indemnities and surety bonds. We are skilled at analyzing loss-mitigation opportunities and prosecuting subrogation claims. With respect to all of these insurance issues, we represent our clients as lead counsel in state and federal courts throughout the country – as well as in front of arbitration panels in the United States, Mexico and Europe – at every stage of complex coverage and claims litigation, from initial policy evaluation through trial and appeal.

What distinguishes our group from others is our ability to guide insurers through the evaluation and resolution of novel and complicated insurance issues, particularly those where we are asked to triage and successfully bring to resolution disputes that had significant adverse developments before our involvement or that may have negative precedential consequences for insurers generally. As an example, we represented the Insurance Association of America as amicus curiae before the Ninth Circuit and Supreme Court on an issue of first impression regarding insurers’ subrogation rights under the Comprehensive Environmental Response, Compensation and Liability Act of 1980 (CERCLA).

Our attorneys provide advice on corporate matters, including assistance in evaluating reserve calculations and facilitating actuarial reviews that enable insurers to better prepare themselves for future risk obligations. Where appropriate, we also recommend and pursue alternative means of dispute resolution to resolve matters without litigation, including assisting clients in the development of language for new policy forms and other potential business resolutions outside the normal context of insurance coverage disputes.

Gardere also has a nationally recognized Insurance Regulatory Practice Group that routinely advises clients on a wide range of complex legislative, regulatory, transactional and compliance issues, including state regulatory initiatives and matters before state regulators. We are active in multiple jurisdictions, with an emphasis on Texas, and stay up-to-date and involved in the National Association of Insurance Commissioners and all matters affecting the insurance industry. We also serve as Texas counsel for the Reinsurance Association of America and National Council on Compensation Insurance. We represent clients in matters involving rate and form filings, compliance, enforcement, reinsurance matters, tax controversies, financial solvency and Own Risk and Solvency Assessment issues, holding company transactions, interpretation and application of statutes and regulations, national licensing or eligibility, mergers and acquisitions, and more.

Our many years of experience, coupled with our breadth of expertise, gives us a unique understanding of insurers’ needs and makes us well-suited to provide the kind of value-oriented, strategic and efficient service that our clients demand.

Search Tips:

You may use the wildcard symbol (*) as a root expander.  A search for "anti*" will find not only "anti", but also "anti-trust", "antique", etc.

Entering two terms together in a search field will behave as though an "OR" is being used.  For example, entering "Antique Motorcars" as a Client Name search will find results with either word in the Client Name.

Operators

AND and OR may be used in a search.  Note: they must be capitalized, e.g., "Project AND Finance."

The + and - sign operators may be used.  The + sign indicates that the term immediately following is required, while the - sign indicates to omit results that contain that term. E.g., "+real -estate" says results must have "real" but not "estate".

To perform an exact phrase search, surround your search phrase with quotation marks.  For example, "Project Finance".

Searches are not case sensitive.
