Our team also has extensive experience in other forms of risk-transfer devices, such as reinsurance treaties, contractual indemnities and surety bonds. We are skilled at analyzing loss-mitigation opportunities and prosecuting subrogation claims. With respect to all of these insurance issues, we represent our clients as lead counsel in state and federal courts throughout the country – as well as in front of arbitration panels in the United States, Mexico and Europe – at every stage of complex coverage and claims litigation, from initial policy evaluation through trial and appeal.
What distinguishes our group from others is our ability to guide insurers through the evaluation and resolution of novel and complicated insurance issues, particularly those where we are asked to triage and successfully bring to resolution disputes that had significant adverse developments before our involvement or that may have negative precedential consequences for insurers generally. As an example, we represented the Insurance Association of America as amicus curiae before the Ninth Circuit and Supreme Court on an issue of first impression regarding insurers’ subrogation rights under the Comprehensive Environmental Response, Compensation and Liability Act of 1980 (CERCLA).
Our attorneys provide advice on corporate matters, including assistance in evaluating reserve calculations and facilitating actuarial reviews that enable insurers to better prepare themselves for future risk obligations. Where appropriate, we also recommend and pursue alternative means of dispute resolution to resolve matters without litigation, including assisting clients in the development of language for new policy forms and other potential business resolutions outside the normal context of insurance coverage disputes.
Gardere also has a nationally recognized Insurance Regulatory Practice Group that routinely advises clients on a wide range of complex legislative, regulatory, transactional and compliance issues, including state regulatory initiatives and matters before state regulators. We are active in multiple jurisdictions, with an emphasis on Texas, and stay up-to-date and involved in the National Association of Insurance Commissioners and all matters affecting the insurance industry. We also serve as Texas counsel for the Reinsurance Association of America and National Council on Compensation Insurance.
