The U.S. District Court for = the Eastern=20 District of Louisiana held that the Federal = Flood=20 Control Act prevents a citizen=92s group from = suing the=20 U.S. Army Corps of Engineers under section 6972 = of RCRA.=20 In In re Katrina Canal Breaches Consolidated = Litigation, the Louisiana Environmental = Action=20 Network argued that the Corps=92s failure to = properly=20 design, construct and maintain flood control = structures=20 in New Orleans resulted in lead and other waste = being=20 deposited in the city=92s Vista Park = neighborhood. The=20 court held that the Flood Control Act gives the = Corps=20 sovereign immunity from liability for flood = control=20 projects covered by the Act.

New EPA = Regulations to=20 Reduce Large Ship Emissions

On Nov. 29, 2007, the U.S.=20 Environmental Protection Agency proposed new = emission=20 standards for diesel engines on large = ocean-going ships=20 that would require the use of high-efficiency=20 after-treatment technology and lower sulfur = marine fuels=20 to reduce NOx and PM emissions. The advance = notice of=20 proposed rulemaking reflects the approach set = out in the=20 U.S. Government's recent proposal to the = International=20 Maritime Organization. The advance notice of = proposed=20 rulemaking targets emissions from the largest = marine=20 diesel engines used primarily for propulsion = power on=20 ocean-going vessels, such as container ships, = tankers,=20 cruise ships and bulk carriers.

Chemical Facility=20 Anti-Terrorism Standard Finalized

On Nov. 20, 2007, the = Department of=20 Homeland Security (=93DHS=94) published the = final version of=20 Appendix A to the Chemical Facility = Anti-Terrorism=20 Standard in the Federal Register. (6 CFR Part = 27).=20 Appendix A lists chemicals of interest and = screening=20 threshold quantities, or STQs. Facilities which = meet or=20 exceed Appendix A thresholds must complete and = file an=20 initial security assessment, known as a = Top-Screen, with=20 DHS by January 19, 2008. DHS will use the Top = Screen to=20 determine if the facility presents a high level = of=20 security risk.

Senate = Committee=20 Approves Bill to Limit Carbon Dioxide = Emissions

On Dec. 6, 2007, the U.S. = Senate=20 Environment and Public Works Committee approved = a bill=20 that sets caps on carbon dioxide emissions from = electric=20 utility, transportation and manufacturing = industries=20 beginning in 2012. If signed into law, the bill = would=20 establish an emission credit trading system that = would=20 award credits to industries that reduced = pollution and=20 allow those that did not reduce emissions to buy = credits=20 from others. The bill is expected to be voted on = by the=20 full Senate in early 2008.

EPA Seeks = Early Input=20 on Standards for Airborne Lead

On Dec. 5, 2007, the United = States=20 Environmental Protection Agency released an = advance=20 notice of proposed rulemaking concerning future=20 revisions to the National Ambient Air Quality = Standards=20 (NAAQS) for lead. The EPA is seeking broad = public input=20 on the policy options under consideration as = part of the=20 lead NAAQS review. A proposal regarding the lead = standards is expected by May 1, 2008.

EPA Issues = Nationwide=20 Smog-Reducing Rule

On Nov. 16, 2007, the United = States=20 Environmental Protection Agency issued its first = regulation to limit emissions of volatile = compounds=20 (VOCs), which react with nitrogen oxides to form = ground-level ozone, or smog. Specifically, the=20 regulation targets emissions from aerosol spray = paints =96=20 paints such as clear coatings, non-flat = coatings, and=20 primers used by consumers. Previous regulations = focused=20 on reducing the compounds by mass, without = regard to=20 their smog-forming potential.

House = Energy Bill=20 Increases Fuel Efficiency Standards

On Dec. 6, 2007, the U.S. = House of=20 Representatives passed an energy bill that = increases=20 federal automobile fuel efficiency standards by = 40=20 percent to an industry average of 35 miles per = gallon by=20 2020. The bill symbolizes the first first major = increase=20 in fuel economy standards in more than 30 years. = The=20 bill also repeals billions of dollars in tax = breaks for=20 oil and gas companies in order to fund tax = incentives=20 for development of renewable energy sources such = as=20 ethanol from grasses and wood chips, biodiesel, = and=20 energy efficiency programs and conservation.

Twelve states sued the = EPA,=20 claiming it violated the Emergency Preparedness = and=20 Community Right-to-Know Act, the Pollution = Prevention=20 Act, and the Administrative Procedure Act when = it=20 revised chemical reporting requirements under = the Toxics=20 Release Inventory program (TRI). Specifically, = the=20 states are challenging a change to TRI that = allows=20 companies that store or release less than 5000 = pounds of=20 toxic chemicals to file shorter, less detailed = forms to=20 comply with reporting requirements.

Bayer = Will Invest=20 $1.5 Billion in Climate Change R&D

As part of the Bayer Climate = Program=20 initiative, Bayer plans to spend $1.5 billion = between=20 2008 and 2010 on research and development = projects that=20 are directed toward solving global warming. = Under the=20 new program, Bayer will add =93climate change = evaluation=20 criteria=94 to the current process it uses to = evaluate=20 certain investment projects and will continue to = use a=20 new control instrument dubbed the =93Bayer = Climate Check=94=20 to increase efficiency and reduce CO2 emissions = from its=20 production plants. Further, several of Bayer=92s = divisions=20 have pledged specific cutbacks on greenhouse gas = emissions by 2020.

Kansas = Rejects=20 Coal-Fired Power Plant Permit

The Kansas Department of = Health and=20 Environment rejected an air permit for a = proposed=20 coal-fired power plant citing threats to public = health=20 and the environment from greenhouse gasses. In = so doing,=20 the Department became the first governmental = agency in=20 the United States to reject an air permit for a=20 coal-fired plant because of carbon dioxide; air = permits=20 have been denied in the past due to sulfur = dioxide,=20 nitrogen oxides and mercury. Sunflower Electric = Power=20 and Tri-State Generation and Transmission = Association,=20 the two electrical cooperatives that applied for = the=20 permit, criticized the Department=92s decision = and said=20 they are examining their legal options.

FTC = Considers=20 Addressing Potential False Carbon Offsets Claims =

The Federal Trade Commission = is=20 requesting comments on whether it should update = its=20 guidelines on environmental marketing claims to = cover=20 the relatively new market for carbon offsets and = renewable energy certificates. The Commission = agreed to=20 review current protections after Rep. Edward J. = Markey=20 (D-Mass.) expressed concern that increased = purchases of=20 carbon offsets, which are largely unregulated, = could=20 lead to false marketing claims regarding the = benefits of=20 the offsets in reducing greenhouse emissions and = addressing global warming.

Climate = Experts=20 Urge Action

Climate experts at a United = Nations=20 conference in Bali urged quick action toward a = new=20 international pact aimed at stopping global = warming. The=20 immediate aim of the conference will be to = initiate=20 negotiations toward a pact to replace the Kyoto = Protocol=20 when it expires in 2012. Delegates at the = conference=20 will be faced with several contentious issues, = including=20 whether greenhouse gas emission cuts should be = mandatory=20 or voluntary and whether countries with = up-and-coming=20 economies, such as China and India, will have to = reduce=20 their rapidly increasing emissions.

Coallition Sues=20 Texas Land Commissioner over Wind Farms

The King Ranch and a = coalition of=20 environmental groups sued Texas Land = Commissioner Jerry=20 Patterson in the U.S. Western District Court in = Austin,=20 claiming the Commissioner was required to = perform=20 environmental review and allow for public = comment on two=20 proposed wind power projects along the Gulf = Coast. In=20 the suit, plaintiffs cite the potential harm = that the=20 turbines could cause to migratory birds as well = as the=20 bay itself and argue that the Federal Coastal = Zone=20 Management Act of 1972 and the Texas Coastal = Management=20 Program require a permit process for any energy=20 generation facility on the coast.

FTC Considers Addressing = Potential False Carbon Offsets Claims

The Federal = Trade Commission is requesting comments on whether it should update its = guidelines on environmental marketing claims to cover the relatively new = market for carbon offsets and renewable energy certificates. The = Commission agreed to review current protections after Rep. Edward J. = Markey (D-Mass.) expressed concern that increased purchases of carbon = offsets, which are largely unregulated, could lead to false marketing = claims regarding the benefits of the offsets in reducing greenhouse = emissions and addressing global warming.

Climate Experts Urge Action

Climate = experts at a United Nations conference in Bali urged quick action toward = a new international pact aimed at stopping global warming. The = immediate aim of the conference will be to initiate negotiations toward = a pact to replace the Kyoto Protocol when it expires in 2012. Delegates = at the conference will be faced with several contentious issues, = including whether greenhouse gas emission cuts should be mandatory or = voluntary and whether countries with up-and-coming economies, such as = China and India, will have to reduce their rapidly increasing = emissions.

Coallition Sues Texas Land = Commissioner over Wind Farms

The King = Ranch and a coalition of environmental groups sued Texas Land = Commissioner Jerry Patterson in the U.S. Western District Court in = Austin, claiming the Commissioner was required to perform environmental = review and allow for public comment on two proposed wind power projects = along the Gulf Coast. In the suit, plaintiffs cite the potential harm = that the turbines could cause to migratory birds as well as the bay = itself and argue that the Federal Coastal Zone Management Act of 1972 = and the Texas Coastal Management Program require a permit process for = any energy generation facility on the coast.
