Practice EmphasisFollowing 12 years of practice as in-house counsel with two FORTUNE 5 companies, David Grant joined Gardere Wynne Sewell LLP as the Firm’s Director of Electronic Discovery. He obtained his experience in all aspects of electronic discovery first at Enron Corp. and most recently at Wal-Mart Stores Inc., the world’ largest retailer. Prior to concentrating on electronic discovery, Mr. Grant maintained a civil trial practice conducting trials in both state and federal courts, and he has tried over 35 jury trials during his career. Mr. Grant’s introduction to electronic discovery occurred as an Assistant General Counsel in the Enron Corp. Litigation Unit. Beginning in 1997, he supervised the development of internet based litigation databases for management of multi-party tort cases, along with a team of lawyers and paralegals to handle the primary legal tasks. In 2001, shortly after the company declared bankruptcy, Mr. Grant was asked to manage the company’s response to the growing number of high profile investigations that were being conducted of the Enron officers and directors. Building on the experience gained in developing the litigation database and legal team, he established company-wide electronic discovery processes that enabled the company to provide complete, professional and consistent responses to the numerous and demanding investigations conducted by the SEC, FBI, Departments of Justice, Labor and Education, FERC, numerous committees of the U.S. Senate and House of Representatives, as well as seemingly countless civil actions. Key elements of the company-wide electronic discovery process that were developed included implementation of material processing protocols, creation of an electronic discovery response team, and development of web-enabled litigation databases. In 2004, Mr. Grant joined Wal-Mart Stores Inc. as the Senior Associate General Counsel responsible for class-action discovery, both traditional and electronic. He developed and implemented discovery management processes that addressed the extraordinary discovery demands that arose from class-actions filed in almost every state, as well as government investigations. As part of the management process, Mr. Grant developed and implemented an electronic discovery solution that addressed both the legal and technical aspects of the company’s nationwide electronic discovery obligations and established compliance with the new federal rules on electronic discovery. Mr. Grant’s discovery practice is founded upon his extensive trial experience that was first obtained at the Harris County District Attorney’s Office, where he was an Assistant District Attorney in the Special Crimes Bureau. After leaving the District Attorney’s office, he tried cases in federal district courts of the Southern and Eastern Districts of Texas and in Texas district courts in Harris and adjoining counties.
